What You Can Claim

Uninsured Motorist

If your injury resulted from a motor vehicle accident in which the responsible driver was uninsured or underinsured, you may be entitled to benefits providing you had UIM (underinsured motorist coverage) on your vehicle, or the owner or operator of the vehicle in which you were at the time of the accident had UIM coverage and even other circumstances where coverage may exist. If there was UIM coverage for the accident, you are entitled to recover those damages to which you otherwise would have recovered from the 'at fault' and under or uninsured motorist. If none of the aforementioned insurance exists, one may still recover for their damages if the party at fault has substantial assets.

Common sense advice: As with any accident that involves visible injuries and other physical evidence it is usually wise to take photographs of the scene, injuries and any other physical evidence (e.g. damaged car; motorcycle; bicycle or any other physical evidence that supports your injury case). Do not speak to any insurance adjusters. No matter how helpful, friendly, or compassionate a liability insurance adjusters may seem, you must always keep in mind that it is the job of that adjuster to limit the amount of money the insurance company will have to pay on your claim to the greatest extent possible. Therefore, do not speak to any insurance company representatives nor sign any documents before you consult with an attorney!
